(a) alter or modify the Services or Service Components, (b) misuse the Services or use them in a way that interferes with the Service Components, the Telus Network or the use of the TELUS Services by others, or in a way that avoids the payment of fees, or (c) use the Services in violation of any law or the rights of another person; or for illegal purposes. Customer is responsible for the selection, delivery, installation, maintenance and security of all equipment, software, data and services necessary for use or use in connection with the Services. You consent to the installation of diagnostic software on your device to help TELUS remotely determine the cause of service or maintenance problems, maintain interactive communication during a diagnostic session, and send instructions to your device to correct incorrect settings if necessary. You agree that TELUS may install updated versions of the diagnostic software on your device for the same purposes without notice. 18.7 When using the wireless features of the Services to access the Internet or any other network or online service, there are certain risks that may allow other Service Users or Internet Users to access the customer`s computer system or service account. Customer should take all appropriate security precautions when using these wireless features, including encrypting their network, installing a firewall and antivirus solution, selecting strong passwords, allowing only pre-approved computers and users on their network, and disabling the computer`s file sharing features when moving their computer outside their home network. / professional. TELUS is not responsible for any claims, damages, losses or expenses related to the use or misuse of the wireless services of the Services, including those arising from the Customer`s use of file sharing, printer sharing or other features that may allow others to access the computer, network or the content of its transmissions by the Customer. To the extent permitted by applicable law, you hereby agree that NI TELUS and its subcontractors (including a central monitoring station providing monitoring services), suppliers, vendors and licensors or their respective affiliates, shareholders, partners, directors, officers, employees and agents (collectively, the « TELUS Parties ») shall not be liable for any consequential lost profits, punitive, indirect, or special damages or losses arising out of or in connection with the Services. With respect to direct damages, you agree that telus` maximum liability is limited to an amount that may not exceed the greater of: (1) two hundred and fifty dollars ($250.00); or (ii) the fees you paid to TELUS for the individual services giving rise to the claim during the twelve (12) months immediately preceding the claim. This limitation of liability clause applies to any of the following misconduct by TELUS parties arising out of or in connection with the Services: breach of contract, negligence of any kind or degree, liability for the no-fault products or any other theory of liability.

This limitation of liability does not apply to intentional, intentional or intentional fault or any other fault if applicable law does not allow a limitation of liability. 31.2 TELUS is under no obligation to notify third parties, including third party providers of services, goods or information, of the suspension, restriction or termination of the customer account. If the Customer`s account is terminated, TELUS has no obligation to transmit unread or unsent messages to the Customer or third parties or to retain any messages, information or other content related to the Customer`s account, and the Customer acknowledges that all such messages, information and content may be deleted immediately. Without limiting the generality of the foregoing, upon termination of the Customer`s account, all email and website addresses relating to his/her account may be immediately deleted and/or assigned to other Customers. TELUS` policies regarding the handling of customer emails when customer accounts are blocked and terminated can be found on the Services website. These limitations of liability extend to third-party providers of audio or audiovisual program services that are transmitted to your device through the Service. In the event that we provide emergency services on a mandatory basis, our liability to you, except in cases where TELUS` negligence results in personal injury, death or damage to your property or premises, will be limited to the greater amount of twenty dollars and three times the amount you may otherwise receive as reimbursement for the provision of defective services under your agreement. 36. You acknowledge that the Services provide access to content, information and materials that are not censored. You acknowledge that certain content, information and materials available through the Services and the Internet may be inaccurate, offensive, harmful or in violation of applicable laws.

TELUS recommends that minors who use the Services be supervised by an adult. 31. You agree that any software and documentation that is part of the Services or provided by TELUS, its agents or agents for use in connection with the Services (the « Software ») is protected by applicable intellectual property laws, remains the exclusive property of TELUS or its suppliers and is delivered in accordance with the terms of this Agreement; including, without limitation, the exclusions and limitations of liability contained herein and the terms of any applicable software license provided to you by TELUS. Unless authorized to do so by TELUS or in the applicable software license, you agree not to inspect the following: You may view all TELUS records in connection with the provision of your Service, provided that you pay TELUS` associated extraordinary costs. You may request that your name and address not be included in a list provided to another person or used by TELUS. If an individual makes a claim against TELUS in connection with the use of our Service or any device on your account, you indemnify TELUS against any loss or expense TELUS may incur, including any judgment rendered against us. You may only use the Services on your premises or, for personal emergency services, on your premises or when the Mobility Service is available in Canada, for your personal use and in accordance with the law. You may not resell the Services, directly or indirectly charge anyone for use of the Services, or order, disconnect, remove, repair or otherwise interfere with TELUS facilities or equipment. You may not use the Services to harass or violate an individual`s reasonable expectation of privacy. You also agree not to threaten, abuse or harass Telus customer representatives.

If there are five or more false positives in a month, TELUS may require a technician to visit your premises to diagnose the problem. Standard fees apply. If a technician visit is not scheduled within thirty days or if the issue cannot be resolved, TELUS may suspend your account until the issue is resolved. (d) any access to and use of the Services, including use in violation of this Agreement, by any person through Customer`s equipment, software or services, or by any person using Customer`s credentials or authorizations necessary to access or use the Services, even if the person or use is not authorized by Customer; and (e) « Liability » means all losses and liabilities suffered by TELUS arising out of any claim against TELUS in connection with the Customer`s equipment, software, data or services or in connection with access to or use of the Services described in paragraph (d). To enable you to post content through the Service over the Internet, you grant TELUS and TELUS service providers a worldwide, royalty-free, unrestricted license to use, reproduce, adapt, transmit, display, communicate and create compilations and derivative works from such content. 23. In no event shall TELUS be liable for any claims, damages, losses or expenses, including but not limited to lost wages or missed work, in the event that a date of installation of the Services is missed, neither by TELUS nor by a third party. If you use the Services in connection with the operation of a business, all claims, other than the recovery of amounts owed to TELUS, relating to (i) your agreement; (ii) use the Services or equipment used with the Services; (iii) sales materials or advertising relating to the Services or devices used with the Services; or (iv) relationships with third parties arising out of the use of the Services shall be subject to private and confidential arbitration before a single arbitrator chosen by the parties, subject to a dispute resolution procedure established by Canadian telecommunications service providers generally to deal with customer complaints.
